The Cookie Policy and the Privacy Policy are integral and essential parts of these Terms. These Terms are binding on the Seller, the Buyer, as well as every Visitor of the online store www.amia.lv. Registered Buyer - Buyer who has filled out and submitted the registration page available in the online store www.amia.lv
Unregistered buyer - or Guest who has not completed and submitted the registration form available in the online store www.amia.lv
Product price stability guarantee period – the end date of the time period until which the Seller has guaranteed not to change the Product prices if the Order is paid for during this time period
Opt-out form – a form that can be used to exercise the opt-out right.
Privacy policy - information on the processing of your personal data in connection with the services we provide.
Cookie policy – an information file that is sent to your computer or other device (for example, a mobile phone) when you visit the relevant website and is stored in the browser.
Courier - a cooperation partner chosen by the Seller, who delivers the Goods paid for by the Buyer on behalf of the Seller.

1. General provisions

    1.1. The Buyer orders, but the Seller undertakes to deliver and hand over food, cosmetics and household goods, hereinafter referred to in the text of the contract as - Goods whose names, assembly, prices, quantity and value of the Goods are agreed when the Customer places the Order and are specified in the invoice.
    1.2. Anyone is entitled to shop in the online store www.amia.lv - both Registered and Unregistered Buyers, and both Natural and Legal persons are eligible to shop.
    1.3. The contract between the Seller and the Buyer enters into force at the moment when the Buyer has selected the Products in the online store www.amia.lv, has agreed to the terms of use of the Internet store and pressed the "Buy" button.
    1.4. The buyer is not entitled to purchase the Goods available in the online store www.amia.lv if he is not familiar with the Purchase Terms or does not agree with them.
    1.5. The Buyer undertakes to order and accept the Goods and to pay the Order price for them in accordance with the procedure specified in the Agreement. Goods are delivered only in the territory specified in the online store www.amia.lv.

2. Registration and processing of personal data

    2.1. The seller undertakes to respect confidentiality and guarantees the security and use of personal data in accordance with the requirements of the Law on the Protection of Personal Data and the Law on Information Society Services. Information may be provided to third parties only in the cases and procedures provided for by the legislation of the Republic of Latvia.
    2.2. The seller undertakes to process the personal data mentioned in this contract, to store them only in accordance with the intended purpose and to the extent necessary for that, including for service improvement, sending out advertising materials. The Seller has the right to transfer the Buyer's personal data to cooperation partners and data processing companies working for the Seller. The collected information may be used for strategic and marketing purposes.
    2.3. In order to become a Registered Buyer, you must fill out the registration page available in the online store www.amia.lv and agree to the Terms of Purchase.
    2.4. When filling out the registration form, the Buyer submits the following Data: Name, Surname, Mobile phone number, E-mail, City / Village, Street / house name, House no. / building, Apartment No., Postal code.
    2.5. By agreeing to the Terms of the online store www.amia.lv, the Buyer agrees to the processing of the provided personal data for the following purposes:

    2.6. The buyer is responsible for the correctness of the data specified during registration, as well as for the user's registration data, the actions performed in the www.amia.lv online store and the consequences resulting from providing false information, including, but not limited to, specifying an incorrect delivery address or mobile phone number .
    2.7. The Buyer is responsible for keeping all the data specified during registration in complete security, and the Seller is not responsible for the losses caused to the Buyer if the Buyer has negligently maintained the registration data, as a result of which they have come into the possession of third parties and have been misused.
    2.8. The Buyer is obliged to immediately report to the Seller about possible manipulations of the Buyer's registration data by third parties, as well as in cases where the Buyer suspects that his registration data has come into the possession of third parties.
    2.9. The Seller has the right to block the Buyer's access to the online store if it believes that third parties are acting maliciously on behalf of the Buyer. The Seller informs the Buyer about blocking access.
    2.10. The Buyer, who is an Unregistered Buyer, by placing an Order in the online store www.amia.lv and providing the requested information, agrees to the Terms and the processing of the personal data provided to the extent necessary for the proper execution of the purchase of Goods, that is:
       2.10.1. For informing buyers, for sale and delivery of goods, for identification of buyers - Name, Surname, Mobile phone number, E-mail, City / Village, Street / house name, House no. / building, Apartment No., Postal code.
    2.11. A registered Buyer has the right to clarify, change, supplement the previously provided data or delete his registration in the online store www.amia.lv at any time.
    2.12. A registered Buyer gets a User profile, password and the right to use the special offers of the online store www.amia.lv. The Registered Buyer is responsible for safe storage of his access data, preventing them from being made available to third parties.

3. Product prices

    3.1. The prices of goods in the online store www.amia.lv are indicated in euros, in accordance with the procedure established in the current regulatory acts. The price includes the value added tax rate (VAT) specified in the current regulations.
    3.2. The price does not include the cost of delivery of the Product. The price of delivery of the goods is specified separately when placing each Order.
3.3. The Goods are sold to the Buyer at the prices valid at the time of purchase of the Goods.
  3.4. The Seller has the right to change the prices of the Goods without prior notice.

4. Availability of goods

    4.1. If any of the Products is not available at the time before the Order is dispatched, the value paid for the Product will be returned to you.
    4.2. If before the Goods are shipped, it is found that a Product is in insufficient quantity, then the insufficient Product is provided to those Buyers who placed the Order first. Buyers to whom the Product cannot be delivered will be refunded the value paid for the Product.

5. Placing the order

    5.1. The order is made by pressing the "BUY" button in the "My Cart" section. It is the Buyer's responsibility to follow the steps of the Goods purchase process, filling in and checking the information required at each step, as well as making sure of the correctness and quantity of the goods placed in the basket.
    5.2. By pressing the "BUY" button, the option to Authorize is offered - enter the profile of a Registered Buyer and complete the purchase or make the purchase of the selected Goods as a Non-Registered Buyer by specifying all the necessary information.
    5.3. If the Registered Buyer has already entered his profile, then the information required for the purchase of Goods must be supplemented with the missing information.
    5.4. The delivery method must be selected during the ordering process.
    5.5. If the Buyer has questions and problems related to placing Orders or other activities in the online store www.amia.lv, the Buyer must contact customer service.

6. Order payment

    6.1. There are 2 payment methods available in the online store:
       6.1.1. With internet banking
       6.1.2. With a payment card
    6.2. A document confirming the purchase, or the delivery note, is sent to the e-mail specified in the order form.
7. Order execution

    7.1. Orders placed in the online store www.amia.lv are processed on working days from 9:00 a.m. to 5:00 p.m.
    7.2. Registered Buyers and Non-Registered Buyers will receive an informative e-mail about the status of the order.
7.3. When choosing delivery to outdoor parcels at high or low temperatures, the Buyer must evaluate the quick removal of the parcel from the parcel. If the Buyer does not have the opportunity to pick up the package quickly, we recommend choosing delivery by courier or indoor parcels. The buyer is responsible for which shipping method he chooses in high or low temperatures. SIA AMIA is not responsible for damages caused by fluctuations in outdoor temperatures.

8. Delivery and receipt of goods

    8.1. The goods are delivered to the address specified by the Buyer in the territory of the Republic of Latvia, which the Buyer specifies before creating each order.
    8.2. Goods are delivered only on working days. The Seller ships the Goods within the same working day, respectively the Order is delivered within one to two working days.
    8.3. The Seller has the right to change the delivery time of the Goods by notifying the Buyer in advance.
    8.4. A delivery fee is payable for the delivery of goods. The delivery fee depends on the chosen delivery method.
    8.5. By choosing to receive the Order at one of the self-service parcels, on the day of the Order's delivery, the Buyer receives an informative text message from the courier, which contains the code for opening the parcel's door.
    8.6. When choosing to receive the Order by Courier to the address specified by the Buyer, the Courier will contact the Buyer on the day of delivery of the Goods to inform the Buyer about the delivery time of the Goods.
    8.7. At the time of product delivery, the Buyer must present an identity document (passport or identity card) to identify the Buyer.
    8.8. If the delivery of the goods to the Buyer is not possible due to circumstances dependent on the Buyer (the Buyer has specified an incorrect address and/or mobile phone number, the Buyer cannot be found at the specified address, it is not possible to contact the Buyer, the specified address cannot be accessed, etc.), the Goods are not sent again (except in cases , when the Buyer has agreed with the Courier, before the Courier's arrival at the specified address, for the second repeat delivery on the next day without changing the original delivery address), but the purchase of the Goods may be cancelled. In this case, the Seller contacts the Buyer to find a solution:
       8.8.1. The Seller cancels the order by refunding the price of the Goods paid for the Goods, but does not refund the price of delivery of the Goods.
       8.8.2. The seller makes repeat deliveries. Additional charges apply for re-delivery.
    8.9. During the delivery of the goods, the Buyer is obliged to make sure that the delivered goods comply with the order.
    8.10. Upon detecting damage or non-compliance with the Order, the Buyer must immediately inform the Seller about it. If the delivery is made by the Courier, the Courier must also be informed of the discrepancy.

9. Right of withdrawal. Exchange and return of goods

    9.1. According to the regulations of the MK no. 255 "Rules on Distance Contracts" The Buyer - a Natural Person may use the right of withdrawal and unilaterally withdraw from the contract within 14 calendar days from the day of delivery of the Goods. The buyer cannot exercise the right of withdrawal if: Goods are delivered that by their nature cannot be returned or are perishable, can be quickly used up, if food or drinks are purchased, as well as if the purchased cosmetic, household chemical or hygiene product has been opened and used.
    9.2. The Buyer is responsible for ensuring that the Product does not lose its value, quality and safety. Otherwise, the Seller has the right to deny the Buyer the right of withdrawal regarding the delivered Product.
    9.3. In order to use the right of cancellation, the Buyer must fill out the Cancellation form available at www.amia.lv within 14 days from the moment he received his Order, indicating the data requested in the form. The waiver form must be submitted:
      9.3.1. electronically at www.amia.lv
      9.3.2. by mail, by courier or personally by sending to the Seller's office in Latvia: Krasta iela 1-94, Jelgava district, Ozolnieki, Latvia, LV-3018.
    9.4. The Product must be submitted along with the completed Cancellation Form.
    9.5. In case of exercise of the right of refusal, the expenses for returning the Product to the online store www.amia.lv shall be borne by the Buyer.
    9.6. The Buyer has the right to exercise the right of withdrawal for all Goods purchased in one Purchase - upon receiving a refund of the amount of the Goods price paid and the Delivery Price, or for a part of the Goods purchased in one purchase, upon receipt of a refund of the Goods price paid for the Goods in respect of which the Buyer has exercised the right of withdrawal.
    9.7. Promotional Goods are returned and money is refunded according to the promotional price of the Goods for which they were purchased.

    9.8. The Seller has the right not to accept the Product and to refuse the Buyer to exercise the right of refusal, as well as not to refund the money paid by the Buyer for the Product, if at the time of the Product's return he has found damage to the Product (removed and/or damaged labels, torn protective films, etc.) and/or signs of use of the Product have been detected .
    9.9. Reimbursement of the paid price of the Goods in cases where the Buyer exercises the right of withdrawal is carried out within the terms and procedures specified in the applicable regulatory acts.

10. Seller's rights and obligations

    10.1. The seller undertakes to provide the Service in accordance with the requirements of the current regulatory acts, with high quality, observing the standards, criteria and ethical norms set for the profession of the Service provider.
    10.2. The seller has the right to engage his own staff or use subcontractors in the provision of the Service.
    10.3. The Seller undertakes to fulfill the Agreement and deliver the Goods to the Buyer in accordance with the terms of the Agreement and in such a package as provided in the Orders.
    10.4. The Seller cannot guarantee that the delivery of the Order will be error-free.
    10.5. If the Seller cannot fulfill any of the conditions of performance contained in the Terms (term, volume, quality, etc.), he will inform the Buyer in a timely manner by contacting the specified phone number or e-mail, stating the reasons and offering to make amendments to the conditions of the Order or the Terms. The solution is found according to the situation by agreement of both parties.

All disagreements and disputes that may arise between the Parties during the execution of the Agreement, the Parties undertake to resolve through mutual negotiations. If no agreement is reached through negotiations, the disputes are considered in the courts of the Republic of Latvia.
